Terms & Conditions of Enrolment

These are Xperts Terms and Conditions of enrolment. Acceptance of these is required to complete the enrolment process.

Please read this information carefully. If you are unclear on any aspect, contact Xperts for clarification.

Enrolments and withdrawals

All enrolment applicants must fill in an electronic course enrolment form and submit that to Xperts.

Each applicant must electronically confirm his/her understanding and acceptance of these Terms and Conditions of Enrolment.

A person may enrol through an agent (for example as part of a workplace group enrolment). In that situation the agent is confirming that each person they enrol agrees to these Enrolment Terms and Conditions.

When Xperts receives an enrolment application a person may be offered a place on the course. This offer is confirmed upon payment of fees in full.

Xperts reserves the right to decline any enrolment.

In special circumstances Xperts may allow deferment of a confirmed enrolment to a later course. Applications for deferment must be made to the Manager of Xperts in writing. If a deferment is granted, an extra administration fee of $35 exc GST may be charged.

Late applications may be accepted at the discretion of the Manager, Xperts in consultation with the course tutor. That decision will be final and binding.

Acceptance of enrolment by Xperts grants access to its course website, the course tutor(s) and on-line communication tools.

Fee payment

Fees must be paid in full before entry to a course can be gained. No credit will be extended.

Fee payments will be accepted only via credit card or by electronic payment direct to Xperts bank account. Cheques are not accepted as a payment method unless prior approval is given by Xperts.

Enrolment cancellations and fee refunds

Requests for cancellation of enrolment must be made in writing to the Manager Xperts and addressed to admin@xperts.co.nz.

The date of withdrawal is when the written notice is received by Xperts.

If a request for cancellation of a paid course enrolment is received:

•    Before the published course start date, Xperts will provide a refund of any fee paid less an administration cost of $120 exc GST.

•    Within 5 days following (and inclusive of) the actual course start date, 65% of the fee paid will be refunded.

•    After 5 days of the course start date, no refunds will be given.

Fee refunds will be processed and dispatched within a maximum of 10 working days.

Duration of an enrolment

The course start date is that published on the course website.

When the published course completion date is reached, the course is finished and all access privileges expire.

Xperts reserves the right to cancel any course before the commencement date – fees and charges paid will be refunded in full to the person or organisation which paid originally, or may be transferred with the agreement of the original payee and used as payment towards another course.

Xperts reserves the right to alter delivery dates/times of a course. Where days, dates or times are altered, Xperts undertakes to attempt to contact all enrolled students either at their stated email address or contact number to inform them of such changes.

Amendments to the course content

Xperts reserves the right to make amendments to course materials during the period of enrolment where such amendments are necessary to ensure currency, accuracy, accessibility or relevance.

Required standards of behaviour

When using the course website all participants are required to use courteous and appropriate language. If a participant fails to comply, Xperts may, at their discretion, cancel his/her enrolment, in which case no fee refund will be made for the remaining portion of the course.

Confidentiality

In completing an enrolment application you are confirming that

•    the stated identity belongs to you,

•    you authorise the use of your unique information for enrolment purposes (see Xperts Privacy Policy),

•    you accept responsibility for all uses of your course login details.

Disputes procedure

The parties will discuss in good faith any disputes between them arising out of these Terms & Conditions of Enrolment.

If discussions fail to resolve the dispute within a reasonable time, then either party may, by written notice to the other, require the dispute be submitted for mediation in Wellington by a single mediator nominated by the President of the Resolution Institute or his or her nominee.

In this event the

• mediator will be deemed to be not acting as an expert or arbitrator;

• mediator will determine the procedure and timetable for the mediation;

• cost of the mediation will be shared equally between the parties.

Intellectual Property

As part of the course Xperts and the tutor(s) supply you with resources that are their respective intellectual property. You agree that you, or any associated party, will not copy, reproduce, redistribute or transmit any part of the supplied course magazines study guides or tutor supplied resources, in any form or by any means, electronic or mechanical, including photocopying and recording or by any information storage or retrieval system, except as expressly permitted in writing by the actual owner of the intellectual property.

Disclaimer

Although Xperts / the course tutor(s) have attempted to make the course information as accurate as possible, it is for training use: to give an overview and understanding and to assist with the implementation of practices within an organisation.

All information is provided in good faith without any express or implied warranty.

Xperts / the course tutor(s) do not accept responsibility for any loss or damage occasioned by the application of course information. All use is at the risk of the user.
